Felony Dismissed On Day of Trial

On the day of trial, the felony charge against Brett Lovins’ client was dismissed. The prosecution entered a nolle prosequi, dismissing the case, after its complaining witness failed to appear to testify as Brett anticipated. By advising his client to refrain from pleading to the crime, and instead requiring the prosecution to prove its case, Brett enabled his client to preserve his record and avoid collateral consequences of a sex crime felony conviction.
