Attorney Brett Lovins won an acquittal for his client charged with operating a motor vehicle under the influence of alcohol (OUI/DUI) after a jury trial in the Malden District Court. The jury deliberated for only an hour before returning the Not Guilty verdict.

After months of negotiation with the prosecuting assistant attorney general, Brett Lovins secured a dismissal of charges related to alleged conduct at the Encore Boston Harbor casino. The case dismissal preserved his client’s clean criminal record and spared his client the adverse immigration consequences associated with a felony conviction.

At a final pretrial hearing, Nelson Lovins obtained a dismissal of all charges for his client accused of domestic assault and battery after the Commonwealth failed to proffer sufficient evidence to move forward to trial.

On the day of trial, Brett Lovins persuaded the court to dismiss the charges against his client based on insufficient evidence after the alleged victim invoked his Fifth Amendment right not to incriminate himself and declined to testify against Brett’s client.

Brett Lovins was able to negotiate a positive outcome for his client who was facing serious charges relating to a motor vehicle accident and allegations of drunk driving (OUI/DUI), leaving the scene of the accident, negligent operation, and driving with a suspended license. Under the agreement reached with the prosecutor in the case, multiple charges were dismissed and the only remaining charge, which was continued without a finding, will be dismissed after the client satisfies probationary conditions.
