The court also found Brett’s client not responsible for a related surchargable civil motor vehicle infraction. The case originated in the Quincy District Court.

Brett Lovins secured a dismissal for his client charged with assault with a knife on the day of trial after the Commonwealth failed to proffer sufficient evidence to prove its case. The case originated in the Malden District Court. 

Brett Lovins successfully moved to exclude the testimony of a police officer who claimed that Brett’s client had confessed to a larceny during a telephone conversation. The Court held an evidentiary hearing and determined that the police officer was unqualified to render an opinion as to the identity of the voice he heard on the telephone. After the testimony was excluded, Brett ultimately reached a favorable resolution of the case for his client. This case originated in the Woburn District Court.
